TERMS & CONDITIONS OF MEMBERSHIP
The Membership fees are those advertised by the Club from time to time.
The Member may pay for the subscription fee in one payment or in monthly instalments. Where the Member elects to pay by monthly instalments the Member is required to enter into a separate personal credit agreement, details of which will be provided to the Member at that time.
Membership prices are subject to immediate change upon notice to the Members but any such price change will not affect any existing Member until their next membership renewal date. The Terms of Membership shall include the Rules and Regulations as amended from time to time.
The Member may cancel their membership in the following circumstances:
before the Club has accepted their Membership.
if the Club is no longer able to provide all or almost all of the facilities (save for reasonable periods of closure for refurbishment or maintenance not exceeding 72 hours).
if the Member is no longer able to take part in any exercise at all for medical reasons
(a doctors note will be required).
if the Member's permanent residence moves outside a 20 mile radius of the Club or where the Member's existing residence is outside 20 miles upon joining the club such change in residence that the parties shall agree between them. Evidence of the new address such as a utility bill or a Solicitors' letter will be required.
if the Club breaches the terms of Membership and fails to remedy the breach within
30 days of receiving notice of the same.
if the Member chooses not the renew their Membership upon expiry.
Where a Member legitimately terminates their Membership a Member who has paid the annual fee as a one off payment shall be entitled to a refund of the portion of the annual Membership that remains unused less the administration fee that is communicated to the Member upon joining the Club. Termination of Membership must be communicated to the Manager of the Club and the Membership card returned.
The Club may terminate any Membership on 4 weeks notice provided that the Club gives sound commercial reasons for the termination such as relocation, insolvency etc. Upon such termination the Club shall refund any such fees that the Member has prepaid relating to the period after the notice has expired.
The Club may terminate any membership immediately if the Club has grounds to expel the Member in accordance with the Rules and Regulations. Any refund will be at the discretion of the Club.
The Member may suspend their membership for up to 6 months at any one time provided that the Member produces medical evidence to the Club that they are temporarily unable to take part in physical activity. Any uncollected amounts for the annual subscription fee shall continue to be collected but the membership shall be extended for such period that the Club and the Member agree after the last payment.
Should any circumstances affecting the Members suitability to participate in exercise arise, it is the responsibility of the individual to notify a member of staff.
The Club accepts no liability for any deterioration in health, however caused, or any injury that occurs from the misuse of the facilities. Members are fully responsible at all times for the exercise they participate in.
The Club can cancel activities or alter equipment and services at their discretion, with or without prior notice, and cannot be held responsible for any services or equipment not available, for whatever reason.
Where a maximum number restricts particular sessions, admittance will be strictly on the basis of first come first served.
Minimum age of Members is 14, Members under 18 must be accompanied by a parent or guardian at all time. Membership agreements for under 18's must be completed and signed by a parent or guardian. Birth Certificates may be requested at the point of purchase for certain Memberships.
Identification documents such as a valid passport or driving licence must be produced on collection of card/cards. New cards must be purchased on transfer. All transfers will be subject to the current transfer fee and at the discretion of the Club. It is the Members responsibility to find a replacement for transfers.
Current fee rates are displayed in the reception area, copies are available on request. All fees are subject to change with 7 days notice.
These Rules and Regulations and these Terms of Membership are the only terms that apply between the Club and the Member unless any amendment or new term is agreed in writing between the Club and the Member. |
